Important Data & Data Localization in China — Basics

Beyond personal information under PIPL, China regulates “important data” and can require localization or security assessment before certain exports—especially in regulated industries and large-scale processing.

Definition

Important data is a Data Security Law concept: data that, if tampered with, destroyed, leaked, or illegally obtained or used, may endanger national security, economic operation, social stability, public health and safety, and so on. Catalogues and industry guidance evolve; companies must classify data, not only copy a GDPR map.

At a glance

  • Run a data inventory that tags personal information, important data candidates, and core data
  • Sector catalogues (auto, industrial, etc.) may expand what counts as important
  • Localization and export assessments can apply even without “personal” data
  • Cloud region choice and admin access from abroad can create export risk
  • CIIOs and processors of large volumes face heightened duties

How it works in practice

Treat classification as a cross-functional project (legal, security, business owners). Do not wait for a single national catalogue to cover every industry. When export is needed, use the CBDT roadmap and path tools; when in doubt, isolate high-risk datasets in China-region systems.

FAQ

Is important data the same as sensitive personal information?

No. Sensitive PI is a PIPL concept about individuals; important data is a national-security/economic-risk concept under the DSL framework.

Does putting data in a China cloud solve everything?

Localization can help for some risks but does not remove access-control, sharing, or PIPL duties. Overseas admin access may still be a transfer.
