Selling China Property as a Foreigner and Remitting Proceeds (2026)

Selling the flat is one file. Getting the money out is a tax-clearance plus SAFE/bank authenticity file — not a suitcase and not friends’ quotas.

Tax clearance · Remit proceeds · Property flagship · Personal FX quota · Inherited funds · Expat banking.

Direct answer

A foreign individual who lawfully owns the unit can generally sell it. City purchase limits are mostly the buyer’s problem. Getting RMB sale proceeds offshore is not the USD 50,000 personal convenience quota. Sequence: contract → tax → transfer registration → bank/SAFE pack. Original inward FX (especially at the same bank) makes the wire easier. RMB-only purchase or a Chinese co-owner is a harder story. Be in China for transfer or use a real notarised/apostilled POA. Inheritance and WFOE dividends are other pages.

QuestionShort answer
Can a foreigner sell?If they lawfully own the unit — generally yes.

Inheritance?Heir SAFE page, not this sale.

Scope and legal framework

Foreign individual home ownership. Foreign individuals who met the then-applicable purchase rules can hold and usually dispose of that unit. Local “can foreigners buy” slogans are not the same as “can this seller transfer title.”

Transfer registration. Title moves at the real-estate registration centre, after taxes the window requires. Identity, marriage status and a proper POA matter more than the listing agent’s WeChat.

SAFE / bank authenticity. Outbound sale proceeds are a documented authenticity review. They are not personal convenience quota and not an underground matching service.

Practical workflow

  1. Confirm title, marital consent, and whether a POA is even acceptable in that city.
  2. Sign; then run tax clearance.
  3. Register the transfer.
  4. Open the remittance pack — preferably at the inbound bank.

Common mistakes

  • Listing before you know who must appear at the window.
  • Promising the buyer a close date before tax is assessed.
  • Treating a Chinese spouse’s quota as the exit ramp.

Action checklist

  1. Title + passport match.
  2. Purchase-fund story (FX inbound vs RMB) written down.
  3. Travel or POA plan.
  4. Tax and remittance pages booked as separate workstreams.

FAQ

Common questions

Quick answers for foreign nationals and employers. Rules vary by city and change over time.

Must I fly to China to sell?

Many windows still want the seller or a tightly drawn notarised/apostilled POA. Do not assume a DocuSign listing agreement is enough for transfer.

We bought in the Chinese spouse’s name. Can I remit “my half”?

The register, not the marriage story, decides who is the seller. Joint title is a facts file on the remittance page — not a 50/50 quota split.
